Gleiss Lutz helps Infineon reach settlement with Qimonda’s insolvency administrator, ending long-standing legal dispute

Gleiss Lutz has represented Infineon Technologies AG (“Infineon”) in negotiations on and the agreement of a settlement with the insolvency administrator of Qimonda AG, advising the management and supervisory boards on the settlement.

The settlement marks the end of the legal dispute pending before Munich I Regional Court since late 2010, in which the insolvency administrator had claimed around EUR 3.4 billion plus interest, including for capital shortfall liability. Infineon will pay EUR 753.5 million under the settlement, comprising a nominal amount of EUR 800 million, less amounts from previous agreements with the insolvency administrator. The agreement settles all disputes and claims of the insolvency administrator against Infineon. Gleiss Lutz represented Infineon in the litigation before Munich I Regional Court from the start of the proceedings.
