The enhancement of private enforcement of EU competition law is a top priority for the European Commission. Private enforcement has a role to play in the area of EU state aid law. Two aspects are crucial for the effectiveness of state aid control: (i) the role of the Member States’ courts in the protection of the rights of competitors; (ii) the enforcement at national level of all "negative" decisions with recovery obligations. In order to increase awareness of the possibilities existing at national level to enforce state aid law, as part of her State Aid Action Plan, EU Competition Commissioner Neelie Kroes commissioned a study on the application of state aid law at Member State level. The study, which was released on 7 April 2006 and is available on the European Commission website will be the subject of this conference.
