Gleiss Lutz has advised ATLAS Elektronik GmbH, a ThyssenKrupp Group company, extensively on strategic and legal issues in connection with the mutual termination of several proceedings before the Bremen public prosecutor’s office. The proceedings concerned alleged compliance violations committed abroad by former employees. The Bremen public prosecutor’s office concluded all proceedings initiated against ATLAS ELEKTRONIK GmbH by issuing a forfeiture order. The company paid EUR 48 million to the state treasury. No fines were imposed. For the company, this closes an unpleasant chapter from the past.
Gleiss Lutz worked together on the matter with company counsel and further criminal and tax law advisors, and was instrumental in negotiating the termination of the proceedings vis-à-vis the authorities. The negotiations were complex, spanning several proceedings and a wide range of legal aspects, which were covered in an extensive opinion and decision paper prepared by Gleiss Lutz for the company and formed the basis for the board’s decision-making process.
Gleiss Lutz also advised the company on handling the legal impact of internal compliance investigations and the enhancement of its compliance and risk management structures. The public prosecutor’s office acknowledged the positive effect of these measures.
