On June 1, 2023, the European Commission endorsed the revised Horizontal Guidelines on the applicability of Article 101 of the Treaty on the Functioning of the European Union to cooperation agreements between competitors, and published a Q&A document on the adoption of the new rules. The revised Horizontal Guidelines accompany the revised Horizontal Block Exemption Regulations on Research and Development and Specialisation agreements.
Firms wishing to enter into cooperation agreements or joint initiatives with actual or potential competitors will need to take account of the new rules, as these will undoubtedly have an impact on the scope and limitations of their cooperation.
