Broad-based expertise in all areas

Gleiss Lutz advises all parties involved in large-scale plant engineering projects (power plants, wind farms, waste incineration plants, industrial production sites and manufacturing plants) and construction projects (high-rises, roads and civil engineering, commercial buildings such as logistics centres) across all phases of project development and implementation. “Industrial clients, in particular, are wowed by Gleiss’s ability to seamlessly integrate specialised expertise from areas such as public, energy, product, procurement and contract law.”

Project structuring

Implementing projects requires structuring a large number of contractual relationships – with consortium partners or shareholders, component suppliers, general planners, project managers, architects and engineers, construction companies (EPC/EPCM contracts), transmission system operators or other project stakeholders.

We have in-depth knowledge and experience of all relevant contract standards, from traditional German agreements to internationally recognised FIDIC or BIMCO contracts. Our experts understand the typical project risks and pitfalls and take the appropriate measures to safeguard clients’ interests. Our extensive experience with complex large-scale projects makes us a highly competent and reliable partner for our clients.

Public law advice

We advise on all aspects of construction and planning law and environmental law, and assist across all phases of commercial and industrial construction projects – including site selection, establishing building rights by means of land use and zoning plans, resolving spatial planning law issues, handling approval procedures under emissions protection, construction and water law, and project implementation itself.

We represent developers in all relevant administrative procedures and defend against third-party objections and appeals before authorities and courts. Our services also include negotiating and concluding urban development contracts with local municipalities.

Alongside the establishment and expansion of commercial and industrial sites, particularly large-scale retail and logistics sites, a special focus of our public law practice is the assistance we provide on energy projects – both renewable and conventional. We also advise our clients on the planning and implementation of large-scale infrastructure projects – whether in aviation, rail, or road construction or in energy sector projects such as power and gas grid expansion and power plant construction.

Project and asset financing

Both borrowers and lenders rely on our lawyers’ high level of expertise in the financing of projects and specific assets as well as borrowing base facilities.

Our many years of advising on financial matters and our in-depth knowledge in the relevant specialist fields enable us to provide clients with targeted, expert advice.

Special focus: energy projects

Our expertise of the energy sector is particularly extensive. We advise on projects such as the construction of onshore and offshore wind turbines, photovoltaic, energy storage and biogas facilities, and green hydrogen projects – from early project planning to commissioning.

We understand the regulatory and economic conditions that apply to the energy market, and we draft to ensure that our clients’ power plant projects are successful. We excel at guiding clients through uncharted territory and implementing projects that incorporate cutting-edge technologies.

Dispute prevention and resolution

Disputes arising from plant and industrial engineering, construction and other projects – and specifically, strategic project management – form an important part of our practice. Cross-border projects, for example, those based on FIDIC or comparable international standards, are a key focus.

We also specialise in identifying potential disputes in complex plant engineering and construction projects at an early stage in order to lay the groundwork for enforcing or defending claims – without losing sight of investment law aspects. Dispute resolution boards, mediation and fast-track procedures are all part of our toolkit for achieving speedy and effective solutions for our clients. Where necessary, we represent clients in national and international arbitration proceedings, as well as before ordinary courts.

Global reach

We advise clients on projects in Germany and abroad, drawing on a proven network of first-class partner law firms when necessary. Our clients benefit from the fact that, as an unmerged German law firm, we can choose the partner firm best suited to the individual project.

Our strong and well-established relationships with leading law firms abroad enable us to provide our clients with the seamless service they expect.
